Tenancy Agreement

Tenancy Agreement is a legal contract between the tenant and the landlord. This agreement will cover all the important facets of renting – from who is responsible for maintenance to how and when payment is to be made.

The agreement must be stamped by LHDN for it to be legal in court. And paying stamp duty is the final step in signing tenancy agreement.

Normally, there are two copies of tenancy agreement (one copy for landlord and another one for tenant) and both of the copies have to be stamped in order to make it legal. You can get it done at Malaysia Inland Revenue Authority, also known as “Lembaga Hasil Dalam Negeri Malaysia”, LHDN Malaysia.

We are now providing e-stamping services using STAMPS by LHDN. The processing charges for every instrument is only RM30 not inclusive of stamping fees.

Stamp Duty Fees

Duration of tenancy         Amount
1 year or less                         RM1
> 2 to 3 years                         RM2
> 4 years onwards                 RM4

*If you’d like an additional copy of the tenancy agreement to be stamped as well, the stamping fee is set at a flat rate of RM10.

Kindly send us the  copy of the agreement/instrument together with all other relevant supporting documents) such as evidence of documents received in Malaysia e.g. courier slip). Please note that we will submit an application for adjudication to LHDNM upon payment of processing fee & estimated stamping fee. Processing Fee is not refundable if you decided to not to stamp the agreement/instrument after submission of adjucation to LHDNM.
